Trial of Rustam Ghazaryan’s Case Completed

Petrosyan, resumed the trial of Rustam Ghazaryan v RA MoH Republican Narcological Center CJSC.
Note that back on November 23, 2015, the Court ruled on re-examination of the case since the Annex received from the RA Court of Civil Appeals was assigned to judge A. Petrosyan following the appeal against another judge’s ruling on returning the claim under this case. The court hearing of December 8, 2015 again was attended only by plaintiff’s representative, HCA Vanadzor Yerevan Office lawyer Tatevik Siradeghyan. Presiding judge A. Petrosyan said that the defendant party had been duly notified of the date and time of the court hearing. As for the plaintiff, the Court was unaware of whether plaintiff R. Ghazaryan was notified or not, although relevant notification had been sent to him. Plaintiff’s representative T. Siradeghyan informed the Court that while R. Ghazaryan had not received any notifications, she informed him of the date and time of the court hearing. Also, T. Siradeghyan filed a motion signed by R. Ghazaryan stating that he was well-aware of the resumed case and the scheduled court hearing but could not attend it due to his heavy workload. The Court decided to continue the hearing without plaintiff R. Ghazaryan and the defendant. At the court hearing, the trial participants discussed attaching the Annex received from the RA Court of Civil Appeals to the case examined by the Court. The plaintiff’s representative T. Siradeghyan noted that the claims previously returned and then admitted by the Court were essentially similar and therefore could not be combined. Hence, she asked the Court to attach the Annex as a case file to the case under examination. Having heard the opinion of the plaintiff’s representative, the Court, guided by the provisions of the RA Civil Procedure Code, ruled by its protocol decision to attach the Annex from the RA Court of Civil Appeals to the case under examination. T. Siradeghyan also submitted to the Court the copies of the indictment and judgment against R. Ghazaryan and then the Court declared the trial completed. The Court will announce its ruling on this case on December 23, 2015, at 5:45 pm.
