Trial examination of Hovhannes Mosyan’s case scheduled

Baghdasaryan, carried on examining the claim against the medical commission decision regarding Hovhannes Mosyan, by which the latter required annulling the decision of the RA Central Medical Commission of January 21, 2016 on granting him a deferment of 10 months from his conscript military service. Note that the previous court hearing was adjourned to receive from the defendant the materials of the completed administrative proceedings.
The initial court hearing was attended by plaintiff’s representatives Gohar Mosyan and Tatevik Siradeghyan, lawyer at HCA Vanadzor Office in Yerevan. Despite the due notification, the defendant party failed to attend the court hearing again. The plaintiff’s representatives had no objections, and the court hearing was resumed in the absence of the defendant party.
Presiding judge K. Baghdasaryan stated that H. Muradyan, RA Military Commissar, provided the Court with the materials of the completed administrative proceedings. The court hearing was interrupted for the plaintiff’s representatives to get familiar with the materials above.
Then Տ. Shiradeghyan submitted to the Court as evidence the response to the inquiry provided by the RA Ministry of Health, according to which Hovhannes Mosyan’s disease and the diseases prescribed under the article applied to him had different codes under the Statistical Classification of Diseases and Related Health Problems, and therefore, the article applied by RA Central Medical Commission might not be applicable to Hovhannes Mosyan.
Hence, the Court considered the case to be ready for trial examination. The trial examination was scheduled for July 28, 2016, at 11 am.
