With the support of the Prosecutor’s Office, the issue of providing the defendant with a new public defender was resolved
10:54, January 5, 2018 | News, Own news | Right to Fair TrialOn October 24, 2017 Nubarashen PI prisoner G. Kh. turned to Helsinki Citizens’ Assembly Vanadzor Office. He informed that he had no connection with the charges that were brought against him, and he refused to be defended by the public defender that he was provided with three times at the court as, in his belief, the public defender was cooperating with the prosecutor. In his application, G. Kh. informed that his request to replace the defender was rejected by the court and that he expected the support of HCA Vanadzor in this matter.
On November 8, 2017 HCA Vanadzor submitted the prisoner’s application to RA General Prosecutor A. Davtyan for discussion.
Not having received any response from the Prosecutor’s office for months, on February 5, 2018 HCA Vanadzor turned to the RA General Prosecutor in connection with the issue of not receiving any response to the letter.
On February 16, 2018 Head of the Investigation Department of Especially Important Cases of the RA Prosecutor’s Office V. Muradyan informed in his response letter that on November 22, 2017, parallel to HCA Vanadzor’s letter, the application by already defendant G. Kh. in which he requested to provide him with a public defender was received by the Prosecutor’s Office of Avan and Nor Nork Administrative Districts of the RA General Prosecutor’s Office.
Although the Prosecutor’s Office does not have the authority to discuss defendants’ applications, instead of returning the application to the applicant, the Prosecutor’s Office of Avan and Nor Nork Administrative Districts preferred to readdress it to the court examining the case and informed prisoner G. Kh. of this through the administration of Nubarashen PI.
The Court of General Jurisdiction of Avan and Nor Nork Administrative Districts upheld the request and turned to the RA Office of the Public Defender with regard to the issue of providing a public defender.
