On April 7, 2017, the General Jurisdiction Court of Arabkir and Kanaker-Zeytun administrative districts of Yerevan, presided by judge A. Nikoghosyan, resumed examination of the complaint of ‘Electric Yerevan’ participant Mikayel Kirakosyan against the RA SIS’s decree on suspending the criminal proceedings initiated on the crime report on forced apprehension and receiving injuries.

The court hearing was attended by M. Kirakosyan, his representative Tatevik Siradeghyan, lawyer at Yerevan Office of HCA Vanadzor, and V. Avetisyan, Deputy Head of the Department for Crimes of Torture and Crimes against Humanity of the RA Special Investigation Service, responsible for the proceedings. The examination of the complaint was not attended by the supervising prosecutor.

After hearing the opinions of the parties, the Court resumed examination of the complaint in the absence of the prosecutor.

The complainant’s representative insisted on the complaint noting that the decree on not initiating criminal prosecution and discontinuing criminal proceedings was ill-founded and led to violation of the rights and freedoms of M. Kirakosyan declared victim under the case and demanded to stop violations. The complaint provided arguments on groundless termination of the assembly, use of excessive physical force, undue restriction of liberty and failure to take relevant measures to prevent the possibility that police officers might agree on their testimonies during the preliminary investigation and prevent official forgery.

V. Avetisyan, Deputy Head of the Department for Crimes of Torture and Crimes against Humanity of the RA Special Investigation Service, objected to the said complaint.

After hearing the opinions of the parties, the Court passed to examination of the evidence and then gave the parties an opportunity to make final speeches and postponed the examination of the complaint to send another notification to the prosecutor.

The next court hearing will be held on May 11, 2017, at 2 pm.
