Successors of the Avetisyans lodged a complaint against Russian Federation to the European Court of Human Rights
10:38, July 14, 2016 | News, Own news | Avetisyan familyAndranik and Narine Poghosyans, successors of Araksya Poghosyan, victim in the Avetisyans family murder case, lodged a complaint, with the support of HCA Vanadzor, against Russian Federation to the European Court of Human Rights on violations of the rights under Article 2 (Right to life) and Article 13 (Right to effective remedy) of the European Convention on Human Rights.
The complaint was substantiated by the fact that there were substantial and procedural violations within the sense of Article 2 of the ECHR. In particular, the state failed in its obligation to prevent the obvious threat to Araksya Poghosyan’s life and that of her family members by having a clear knowledge that Valery Permyakov was not subject to conscription and all the more so had no right to do a military service with the use of arms.
Also, the Russian side failed to duly and timely inform Armenian law enforcement officers that V. Permyakov had deserted the military unit, whereas such information in due time might have prevented the tragedy.
As for the procedural violation, firstly, the investigation carried out by the Russian side was unavailable to the victim’s successors and as a result, they were deprived of the opportunity to exercise their rights within the case, particularly to file motions, appeal the decisions of the agency responsible for preliminary investigation, etc.
Also, no official was held liable for informing the RA law enforcement agencies with a delay of almost 3 hours of V. Permyakov’s voluntary desertion from the military unit.
There are no national mechanisms to restore the rights of the victim’s successors within the sense of Article 13 of the ECHR since the aggrieved party gained access to the files of the investigation carried out by the Russian side no sooner than almost 3 month after the final decision was issued, when the Investigative Committee of Russian Federation had already completed all the proceedings on the murder of the Avetisyans family and V. Permyakov was sentenced to an imprisonment of ten years.
