‘Sari Tagh’ protest participant Hrachya Boyajyan’s attorney was not duly notified of the progress of the proceedings and was thus deprived of the opportunity to submit motions
18:19, November 29, 2016 | News, Own news | Sasna TsrerOn November 24, 2016, the General Jurisdiction Court of Erebuni and Nubarashen administrative districts scheduled the first court hearing on ‘Sari Tagh’ protest participant Hrachya Boyajyan’s case under the charges brought against him for using violence against RA Police officers under Article 316(2) of the RA Criminal Code, by throwing on them stones and other objects on July 19, 2016, in the intersection area of Glinka and Vormnadirneri Streets adjacent to M. Khorenatsi Street in Yerevan city.
However, despite the judge’s allegation, the defense party, namely Arayik Zalyan, attorney at HCA Vanadzor, was not duly notified of the court hearing.
Neither did the defense party receive the ruling on admitting the criminal case and clarifications on submitting to the court relevant applications and motions; as a result, by missing the time limits set by law, i.e. before the scheduled date of trial examination of the case, the defense party was deprived of the opportunity to submit motions.
Also, after the preliminary investigation into the case was completed, Hr. Boyajyan’s attorney Arayik Zalyan submitted a motion on discontinuing the proceedings or re-qualifying the action. While in his verbal objection to the investigator’s motion on extending Hr. Boyajyan’s detention A. Zalyan also provided arguments on inaccurate and unfounded legal assessment of Hr. Boyajyan’s actions, in this case he was also actually deprived of the opportunity to submit a motion on discontinuing the case proceedings and returning the case to the prosecutor before the scheduled date of trial examination of the case.
The next court hearing of the case under the charges brought against Hr. Boyajyan is scheduled for December 26, 2016, at 3 pm.
