The Court found that Gayane Arustamyan’s rights and freedoms were not violated
12:43, March 31, 2016 | News, Own news | Gayane Arustamyan, on March 17, 2016, the General Jurisdiction Court of Arabkir and Kanaker-Zeytun administrative districts, Yerevan, RA, dismissed the complaint of Gayane Arustamyan’s representative Artur Sakunts, Chairman of HCA Vanadzor, against RA SIS Senior Investigator for High-Profile Cases A. Tadevosyan’s decree of August 8, 2015. By the complaint above, A. Sakunts required to send the case to re-examination and compel the investigating agency to stop violation of Gayane Arustamyan’s rights and freedoms.
Note that on May 8, 2015, Gayane Arustamyan and on May 13, 2015, HCA Vanadzor filed a crime report on the ill-treatment by police officers towards Gayane Arustamyan on May 7, 2015.
On May 13, 2015, the RA SIS initiated criminal proceedings under Article 309(2) of the RA Criminal Code, which was later discontinued.
HCA Vanadzor appealed the decree of the RA SIS Senior Investigator for High-Profile Cases A. Tadevosyan dated August 8, 2015 first to higher instances and then to a court of law.
The complaint submitted to the Court was substantiated by the fact that the measures taken by the preliminary investigation agency contained omissions, the evidence under the case was not assessed objectively, and the decree to reject initiation of criminal proceedings was made in violation of G. Arustamyan’s rights and freedoms.
By its ruling of March 17, 2016, the General Jurisdiction Court of Arabkir and Kanaker-Zeytun administrative districts of Yerevan, RA dismissed the complaint of A. Sakunts finding that the actions complained of were in compliance with the law and the person’s rights and freedoms were not violated.
The Court finds that a full, thorough and objective investigation has been carried out. At the same time, the factual circumstances obtained during the preliminary investigation do not give any grounds to assume that the actions of the police officers contained the corpus delicti under Article 309, RA Criminal Code.
As we have already reported, Gayane Arustamyan and her representative, Artur Sakunts, Chairman of HCA Vanadzor, intend to appeal the ruling of the General Jurisdiction Court of Arabkir and Kanaker-Zeytun administrative districts of Yerevan, RA dated March 17, 2016.
