Court Ruling on Arman Antonyan’s Case to Be Appealed at RA Criminal Court of Appeal

Makyan, resumed examination of victim’s successor Susanna Antonyan’s representatives Artur Sakunts’ and Arayik Zalyan’s appeal on the criminal proceedings of Arman Antonyan’s death. The hearing was attended only by the appellant’s representative A. Sakunts. As for the investigating agency, represented by A. Geghamyan, Investigator at the Investigation Division of Kentron and Nork-Marash administrative districts, Yerevan City Investigation Department, RA Investigative Committee, and H. Sargsyan, Prosecutor at Prosecutor’s Office of Kentron and Nork-Marash administrative districts, Yerevan City Prosecutor’s Office, they did not attend the hearing. A. Sakunts left the issue of resuming the examination of the appeal without the investigative agency and the supervising prosecutor to the discretion of the Court. Presiding judge M. Makyan mentioned that A. Geghamyan and H. Sargsyan had provided their objections to the appeal at the previous court hearing and therefore found that the hearing might be resumed in their absence. A. Sakunts provided some supplementary notes to the appeal regarding some flaws indentified by the ruling of the RA Cassation Court. Particularly, in his supplementary notes, A. Sakunts stated that the supplementary preliminary investigation failed to remove the flaws and violations committed during the previous preliminary investigation and identified by the ruling above and therefore insisted on his appeal. The Court considered the examination of the appeal to be completed and went to the retiring room to make a ruling. By its decree of September 16, 2015, the Court dismissed the appeal filed by A. Sakunts and A. Zalyan against the decree of A. Geghamyan, Investigator at the Investigation Division of Kentron and Nork-Marash administrative districts, Yerevan City Investigation Department, RA Investigative Committee, to discontinue criminal proceedings and not to initiate criminal prosecution on Arman Antonyan’s death, by upholding the legality of the decree above. S. Antonyan’s legal representatives will appeal the ruling of the First Instance Court of General Jurisdiction of Kentron and Nork-Marash administrative districts, Yerevan, RA within the prescribed terms to the RA Criminal Court of Appeal.
Note that in the period of January 17-February 27, 2010, A. Antonyan received treatment for infertility at the Yerevan Sexopathologic Rehabilitation Center. In late March, 2010, A. Antonyan’s health deteriorated rapidly, and he was taken first to Vanadzor Medical Complex № 1 and then to Infection Hospital. On April 1, 2010, unconscious and in coma, he was taken to Yerevan Nork Infection Clinic where he later died of hepatitis В without regaining consciousness.
