Examination of Conscript Hovhannes Mosyan’s Case Appeal Commenced

Avetisyan, commenced examining the appeal filed by Gohar and Hovhannes Mosyans. By their appeal, the latter requested to annul the decree of High-Profile Cases Investigator S. Arakelyan at the RA SIS General Crimes Investigation Department dated July 31, 2015 on not initiating criminal proceedings and send the case for preliminary investigation. First, the HCA Vanadzor and then Gohar and Hovhannes Mosyans filed a crime report to the RA SIS on inhuman and degrading treatment, unlawful deprivation of liberty and obstructed exercise of the right to an attorney of conscript Hovhannes Mosyan by S. Varantsovyan, Investigator at the 4th Garrison Investigation Department of the RA Investigative Committee Military Criminal Cases Department. Yet, after collection of the case files, S. Arakelyan decreed to reject initiation of a criminal case due to absence of corpus delicti. The examination of the appeal was attended by G. Mosyan and her representative, HCA Vanadzor lawyer Tatevik Siradeghyan. Despite of proper notification of the date and time of the court hearing, the investigating agency did not attend the hearing but had submitted to the Court the case files in advance. Upon verifying the identities of the appellant and her representative and the absence of any grounds for recusation and self-recusation, the Court passed to the examination of the appeal. T. Siradeghyan stated that the appellant party had not yet got familiar with the files provided by the investigating agency and requested the Court to adjourn the examination of the appeal, so that it might get familiar with the files above and accordingly submit further grounds for the appeal. The Court found the motion well-grounded, considered it necessary for the investigating agency to attend the examination of the appeal and therefore decided to adjourn the hearing. The next court hearing is scheduled for November 12, 2015 at 10:30 am.
