The examination of the claim demanding to cease the construction works at Vanadzor’s Artsakh Park is to commence on May 18, 2018
10:33, February 28, 2018 | News, Own newsThe RA Administrative Court has started proceedings on HCA Vanadzor’s claim demanding to cease the construction works at Vanadzor’s Artsakh Park.
The first preliminary court hearing is scheduled for May 18, 2018.
HCA Vanadzor applied to the court on January 24, 2018, when Mayor of Vanadzor Mamikon Aslanyan did not see any grounds for ceasing the construction works that were being conducted without the consent of the Ministry of Culture and the Regional Administration of Lori Province at the park considered as a monument.
HCA Vanadzor turned to the mayor of Vanadzor with the claim to cease the construction works twice – on November 15 and December 9, 2017. However, both times the Organization received a rejection.
Despite the fact that the State Urban Development Committee Adjunct to the Government of the RA informed HCA Vanadzor that Artsakh Park is considered to be a monument and is included in the Map of State and Cultural Monuments of the Master Plan, in the redeveloped master plan approved by the Council of Elders of Vanadzor in 2014, Artsakh Park is not considered as a specially protected area. It was alienated to G & M LLC for the reconstruction and maintenance of the outdoor café and recreational area yet in 2016. On October 12, 2017 Vanadzor’s City Council granted a construction permit to G & M LLC. Following this, the construction works commenced.
It should be noted that in accordance with the provisions of the Land Code of the RA, it is prohibited both to transfer the lands of historic and cultural importance to other persons with the right of ownership and to perform any act that contradicts their target and operational significance. And when conducting construction works, the designs should be agreed by competent bodies.
However, in response to the inquiries submitted by HCA Vanadzor, the RA Ministry of Culture and the Regional Administration of Lori Province informed that the proposal for land allocation and the sketches of the buildings to be constructed were not agreed by them.
In fact, the established norms were not complied with; therefore, the construction works at Artsakh Park are being conducted in grave violation of the law.
The examination of the claim is set to commence at 12.00 noon at the RA Administrative Court.
Incidentally, the construction works are currently in progress and will probably have finished by May 18.
