The RA General Prosecutor’s Office did not see any elements of crime in Serzh Sargsyan’s announcement
12:27, January 24, 2018 | News, Own newsThe RA Prosecutor’s Office responded with regard to HCA Vanadzor’s report on initiating a criminal case on the basis of Serzh Sargsyan’s announcement.
HCA Vanadzor presented a crime report on December 13, 2017 and demanded to initiate a criminal case on the basis of the announcement made by Serzh Sargsyan at the forum on local self-government and territorial administration authorities in Dilijan.
In this announcement, Serzh Sargsyan stated in particular, “It is not a secret that many community leaders abuse their position and use it to obtain incomprehensible and unacceptable incomes, starting from alienating lands belonging to the communities by trickery and different means and treating the community budgets dishonestly.”
Then, he added, “We have been very forgiving to the community leaders. We have been forgiving as we believed that they had to fulfill themselves, the system had to fulfill itself and during this period some negative manifestations are possible. I would like to warn all of you, not to scare you, just to warn you that if anyone needs to practice these things, they had better go and work in a different place. We are not ready to see how some of you are taking the money of our population to your homes. It’s a shame!”
HCA Vanadzor recorded that Serzh Sargsyan had deliberately concealed the crimes conducted by the community leaders, as a result of which they had not been subjected to legal assessment. On this ground, HCA Vanadzor demanded to prosecute Serzh Sargsyan, the community leaders mentioned in his announcement and the mediators to forgive those leaders under a number of articles of the RA Criminal Code (including on suspicion of abuse of official authority, concealment of crime and taking bribes).
A. Simonyan, Head of Department for Combating Corruption and Economic Crimes of the RA Prosecutor’s Office, did not see any data indicating elements of crime in the report submitted by HCA Vanadzor that “can serve as a basis for checking, initiating a criminal case or making a decision on rejecting the criminal case.”
Moreover, once again the RA General Prosecutor’s Office did not make a decision on initiating a criminal case, but simply sent a response letter, demonstrating inactivity.
HCA Vanadzor applied to the court once again with a claim to eliminate the inactivity shown by the RA General Prosecutor’s Office and to oblige it to make a decision as established by the law.
