Criminal proceedings initiated on abuse of power by Compulsory Enforcement Service officers

P. from Yerevan city, consulted the Yerevan Office of Helsinki Citizens’ Assembly Vanadzor and stated that the movable property in the apartment owned by her was arrested by a court ruling. At the same time, she added that the compulsory enforcement actions had been ended by decrees of November 30, 2015.
On January 21, 2016, the Compulsory Enforcement Service officers visited her apartment without any ruling and proper notification and said that they sought to check the condition of the arrested property and confiscate it. The neighbors who were at A. P.’s place at that time tried to prevent the illegal actions by the Compulsory Enforcement Service officers noting that the latter had no right to take such actions without the owner of the apartment.
According to A. P.’s application, the Compulsory Enforcement Service officers made some records and left.
On February 24, 2016, HCA Vanadzor submitted a crime report to the RA Special Investigation Service based on the citizen’s application on due investigation into the facts in A. P.’s application submitted to the Organization, initiating criminal proceedings in case of revealing any signs of the alleged crime, revealing the officials responsible and restoring A. Poghosyan’s violated rights.
On March 3, 2016, the RA Special Investigation Service readdressed the crime report of HCA Vanadzor to the RA MoJ Compulsory Enforcement Service, which by its letter of March 14, 2016 considered the actions of the CES officers lawful.
The RA Special Investigation Service failed to make any decree under the RA Code of Criminal Procedure and thus showed inaction.
In this regard, on March 11, 2016, HCA Vanadzor filed an application with the RA Prosecutor General’s Office on compelling the RA Special Investigation Service to make a decree under Article 181 of the RA Code of Criminal Procedure.
On April 4, 2016, the RA Special Investigation Service decreed to initiate criminal proceedings on the abuse of powers by officials under Article 309(1) of the RA Criminal Code.
