Avan Mental Health Center CJSC v. HCA Vanadzor and Zhuleta Amarikyan Court Hearing Held
15:40, June 27, 2015 | News, Own newsOn June 25, 2015, the Lori Marz (region) Court of General Jurisdiction, presided by judge V. Hovnanyan, held a court hearing on the Avan Mental Health Center CJSC v. Zhuleta Amarikyan and HCA Vanadzor.
The hearing was attended by the plaintiff’s advocate Edgar Bademyan and Arayik Zalyan, representative of the defendant HCA Vanadzor. Neither defendant Zhuleta Amarikyan, nor her representative attended the court hearing. Considering that Zhuleta Amarikyan had been properly notified of the hearing, the Court decided to continue the trial in her absence. At the hearing, the judge asked the plaintiff to clarify the subject matter of the claim, since according to him, the basis underlying the claim was quite clear, and its subject was not.
The plaintiff verbally clarified the subject matter of the claim which would be later submitted to the Court also in writing. The plaintiff demanded that the HCA Vanadzor published the court ruling in the same sources and same number of printed copies as it had previously published the defamatory and offensive (according to the plaintiff) allegation about the Avan Mental Health Center (note that such publication was placed in the HCA Vanadzor Report on Human Rights Situation in RA Psycho-Neurologic Facilities in 2013: Hospital can Never Become Home for…Anyone).
At the hearing, Arayik Zalyan, the HCA Vanadzor representative filed a motion to involve only Zhuleta Amarikyan as a defendant party, since the HCA Vanadzor was an improper defendant in this case, and the claim against the Organization and Zhuleta Amarikyani was filed based on the testimonies provided by Zhuleta Amarikyan. However, the Court dismissed the motion. The both parities to the trial motioned to involve witnesses, and the Court approved them. The next court hearing was scheduled for August 21, 12 pm.
