Initial pre-trial court hearing on Svetlana Sargsyan v. RA Military Commissariat held
12:26, March 30, 2016 | News, Own newsOn March 29, 2016, the RA Administrative Court, presided by K. Avetisyan, held the initial pre-trial hearing on Svetlana Sargsyan v. RA Military Commissariat, following a claim. By her claim submitted to the Court, S. Sargsyan required to annul the interfering administrative act of RA military commissioner H. Muradyan dated May 11, 2015, as well as to oblige him to pay her the outstanding military pension funds paid in cases of losing the breadwinner and to compel him to award her a bonus starting from January 1, 2015.
The pre-trial court hearing was attended by plaintiff Svetlana Sargsyan and her representative, Tatevik Siradeghyan, HCA Vanadzor lawyer.
The defendant did not attend the court hearing, but filed a motion to the court on involving a proper defendant under the case on the pretext that under a Government Decree, the RA Military Commissariat makes part of the General Staff of the RA Armed Forces, a state agency functioning under the RA Defense Ministry.
T. Siradeghyan stated that at the time of submitting the claim, the defendant was selected with reservation considering that the pension for losing a breadwinner was assigned and paid to the plaintiff by the military commissariat.
Plaintiff’s representative T. Siradeghyan motioned that the Court also involved in the case the RA Ministry of Defense as a defendant and the State Social Security Service of the RA Ministry of Labor and Social Affairs as a third party.
Having granted the motion above, the Court adjourned the court hearing to send notification to the other agencies involved in the case and scheduled another pre-trial court hearing.
The next pre-trial court hearing will be held on April 27, 2016, at 11:30 am.
