Ani Boshyan’s Case Appeal Dismissed

Mkrtchyan, resumed examination of the appeal by victim A. Boshyan’s legal representatives Artur Sakunts and Arayik Zalyan against the RA SIS investigator N. Barseghyan’s decree on not initiating criminal prosecution and discontinuing criminal proceedings. Note that the previous court hearing on these proceedings was adjourned due to the vacation of the investigating agency representative. The court hearing in question was attended by A. Boshyan’s representative A. Sakunts and RA SIS investigator N. Barseghyan. In his objections to the appeal, N. Barseghyan noted that the criminal proceedings files covered no sufficient data on exacting testimonies from A. Boshyan, and each argument presented by her to the investigating agency received due attention and resulted in a decree to discontinue criminal proceedings on the basis of lack of any elements of crime. N. Barseghyan also noted that there was no need to assign any psychiatric or psychological expert examination under A. Boshyan’s case since no psychiatric forensic examination would be able to reveal the fact of breaking A. Boshyan’s will as pointed out by the appellants, and likewise no psychological examination would be able to reveal the pressure exerted on A. Boshyan. In his statement on the objections of the investigating agency, A. Sakunts said that many questions in the appeal had received no answer, there were blatant contradictions in the testimonies of the witnesses involved in the case, and no investigation was carried out to find out the reasons why A. Boshyan’s father, Hakob Boshyan was kept at the police. Hence, considering the arguments presented to the Court sufficient, A. Boshyan’s representative requested the Court to uphold the appeal and stop violation of the appellant’s rights and freedoms. Afterwards, the Court passed to the publication of the appeal files and then went to the retiring room to make a ruling. After a while, the presiding judge A. Mkrtchyan announced his ruling to dismiss victim Ani Boshyan’s representative Artur Sakunt’s appeal against RA SIS investigator N. Barsheghyan’s decree not to initiate criminal prosecution and discontinue criminal proceedings. A. Boshyan’s legal representatives will appeal the court ruling to the RA Court of Criminal Appeal.
