15:58, October 20, 2015 | News, Own news | Freedom of Movement, Right to be free from torture and inhuman or degrading treatment, Right to liberty and securityUnder the hearing of October 19, 2015 at the RA Administrative Court, presided by judge H. Ayvazyan, on the examination of the RA Police claim against Gayane Arustamyan on bringing her to administrative responsibility, another pre-trial court hearing was held. Note that the previous hearing was adjourned to consider G. Arustamyan’s representative HCA Vanadzor lawyer Tatevik Siradeghyan’s motion on the unconstitutionality of Article 172.3 of the RA Code of Administrative Offences. By the motion above, the latter required that the Court discontinued the proceedings and applied to the RA Constitutional Court. The court hearing was attended by representative of the plaintiff RA Police, Sona Melikyan, Senior Legal Adviser at Kentron Division, RA Police Yerevan City Department, and defendant Gayane Arustamyan’s legal representative T. Siradeghyan. Upon examining the motion filed by the defendant’s representative at the previous court hearing, presiding judge H. Ayvazyan ruled to reject it stating that at the moment the Court could see no grounds to grant the motion. T. Siradeghyan requested the Court to adjourn the hearing since she intended to file a counter-claim, which depended on the Court’s decision on the motion above, and therefore she needed some additional time to file the counter-claim. The Court considered the motion well-grounded and granted it. Plaintiff’s representative Sona Melikyan submitted to the Court the video of G. Arustamyan’s interview to the journalists upon her coming out of the police station on the day of the incident. Hence, the court hearing was adjourned. As for the date and time on the next court hearing, the parties to the trial will be informed of it later.
