Khudoyans’ Case again under Examination at RA Cassation Court
23:48, October 2, 2015 | News, Own newsIn already stated, the HCA Vanadzor has assumed the protection of the violated rights of Ashot Khudoyan and Heghine Makaryan, forcibly removed from their sit-in area at the RA presidential residence on December 2, 2013. Note that starting from November 28, 2013 they had started a sit-in in front of the RA presidential residence regarding their housing issue and a few days later were violently removed from there by the RA Police officers due to the official visit of the Russian Federation President Vladimir Putin. Following the reports on the incident filed by Artur Sakunts, Chairman of Helsinki Citizens’ Assembly Vanadzor, and H. Makaryan, on March 3, 2014, the RA Special Investigation Service acting investigator H. R. Harutyunyan decreed to reject initiating criminal proceedings due to lack of any elements of crime in the police actions. The decree above was appealed first to a first instance court of general jurisdiction and then to the RA Court of Appeal, which both upheld it. A. Sakunts and H. Makaryan’s legal representative, HCA Vanadzor lawyer Tatevik Siradeghyan appealed the RA Court of Appeal ruling to the RA Cassation Court. However, on September 18, 2014, the Cassation Court ruled not to examine the appeal, since it was not signed by the attorney. Later, on March 17, 2015, the RA Constitutional Court declared the provisions in the RA Criminal Procedure Code on binding requirement for appeals to be signed by attorneys unconstitutional and invalid. Based on the Constitutional Court ruling above, on June 20, 2015, the HCA Vanadzor Chairman A. Sakunts and H. Makaryan’s legal representative T. Siradeghyan filed another appeal with the RA Cassation Court on the new evidence requesting to revoke the ruling of the RA Court of Criminal Appeals dated July 16, 2014 and submit the case to lower courts for re-examination. Upon considering the issue of admitting the RA Criminal Court ruling of September 18, 2014, the RA Cassation Court found that the appeal filed by the HCA Vanadzor Chairman A. Sakunts and T. Siradeghyan complied with the requirements to review the case due to new evidence and ruled to therefore initiate proceedings to review its own ruling of September 18, 2014. Hence, the appeal filed to the RA Court of Appeal back in August 8, 2014 to protect the rights of A. Khudoyan and H. Makaryan will be admitted again by the RA Cassation Court.
