The RA Cassation Court returned the appeal of Tigran Varyan’s case
13:46, January 16, 2014 | News, Own news | Right to Fair Trial, Right to Life, Rights of Soldiers/Recruits | Armed Forces, Tigran VaryanIt has been almost two years after the death of DA #38862 military unit KS-19 battery management platoon radio communication squad radio-telephonist, obligatory term soldier, private Tigran Varyan. Until present Tigran Varyan’s father Vano Varyan has been attempting to find his son’s real perpetrators in various court instances.
On December 5, 2013 Vano Varyan’s representative Artur Sakunts sent a cassation appeal to the RA Cassation Court with a demand to quash October 28, 2013 decision made by the RA Criminal Court of Appeals and send the case for trial to the same court with new personnel.
By discussing the appeal of the representative of the victim’s legal successor Artur Sakunts, on October 28, 2013 the RA Court of Appeals decided to decline the appeals of both A. Sakunts and accusing party K. Aghabekyan. Via this decision the RA Court of Appeals decided to leave August 6, 2013 decision in legal force, whereby, Hovhannes Hakobyan, Gevorg Manukyan and Erik Sargsyan were found guilty.
Through October 28, 2013 decision October 3, 2013 amnesty was applied in relation to Erik Sargsyan and criminal prosecution against him terminated.
On December 5, 2013 the appeal sent to the Ra Cassation Court along with December 27, 2013 decision of the Court of Appeals was returned to applicant A. Sakunts.
Once again failing to achieve the implementation of justice over the case of soldier’s death, an application to apply to Strasbourg Human Rights Court will be compiled.
