Who did Jhangiryan mean by saying Murderers?
07:00, April 12, 2013 | News | Right to Fair Trial, Right to Life, Rights of Soldiers/Recruits | Armed ForcesToday the subsequent preliminary court trial, presided by Judge Simizar Hovsepyan, was resumed at the Court of Common Jurisdiction of Arabkir and Qanaqer-Zeytun Administrative Districts based on the claim of Arayik Zalyan, Musa Serobyan and Razmik , the acquitted over the “Mataghis” case. They demand from the former Prosecutor, member of National Assembly ANC faction Gagik Jhangiryan to compensate for the damage caused to their prestige, dignity and business reputation and to make a public apology. In an interview published at Aravot.am on December 18 of last year, Gagik Jhangiryan made the following statement, “They are the murderers and they should serve their sentence, I haven’t changed my opinion”.
Today during the preliminary court hearing, G. Jhangiryan’s advocate Vahe Hovsepyan declared that Jhangiryan’s statements were directed not at the claimants specifically but at indefinite individuals in general. Plaintiff Arayik Zalyan objected to the statement made by the responding party representative by bringing in an argument that by saying “Mataghis” case, Jhangiryan meant them, since during the office years of the military Prosecutor, the three of them had been in jail for 2 years and 8 months.
Arayik Zalyan also noted that in the objections sent to the court the responding party had highlighted he had a right to express his opinion. “In one case he admits expressing an opinion, while, in the other case he states that his opinion doesn’t relate to us”, stated A. Zalyan by revealing another statement Jhangiryan had made, which read, “It isn’t me who should feel bad about this, but those people that the murderers are in liberty.” By the way, the burden of proving this was imposed on the claimant: Jhangiryan should explain who his statements were directed at.
It should be noted that the plaintiff party demands from Jhangiryan 100.000 AMD for insult and 200.000 AMD for violating their presumption of innocence.
The hearing ended and the Judge announced the subsequent court trial to be held on May 23.
