13:23, May 1, 2014 | News, Own news | Rights of Soldiers/Recruits | Armed ForcesOn April 28, 2014, the RA Criminal Court of Appeals, presided by judge E. Darbinyan, resumed proceedings on the case of conscript soldier Hayk Kaleyan deceased at the Defense Army military unit № 35383. Note that the previous court hearing on this case was delayed to ensure the presence of the prosecution.
The hearing was attended by the defendants Santur Dombryan, Armen Yeremyan and Narek Serobyan, Santur Dombryan’s advocate, aggrieved party’s successor Meruzhan Kaleyan and his representative Artur Sakunts. Prosecutor Hayk Mkrtchyan, prosecutor at the Askeran town №1 garrison military prosecutor’s office, was absent, and the Court had received a reference on his in-patient treatment. Instead, Anahit Yeghiazaryan attended the trial and submitted to the Court a power of attorney on behalf of the deputy military prosecutor to be involved as part of the prosecuting party.
At the proceedings, the representative of the aggrieved party’s successor, A. Sakunts and S. Dombryan’s advocate presented the grounds underlying their complaints. Other defendants A. Yeremyan and N. Serobyan expressed their solidarity with S. Dombryan’s complaint and objected to the appeal of the aggrieved party’s legal representative A. Sakunts.
Prosecutor A. Yeghiazaryan declared that she had been involved in the case recently and was unaware of the case materials. She, therefore, asked the Court for some time particularly to submit a detailed response to A. Sakunts’ appeal. A. Yeghiazaryan also informed the Court that Prosecutor H. Mkrtchyan wished to attend the proceedings personally and, therefore, asked to delay the hearing.
The successor of the aggrieved party and his legal representative as well as Santur Dombryan’s advocate did not object to delaying the court hearing, and S. Dombryan solicited the Court to postpone the hearing for the shortest period possible as he had already been serving his sentence for a year and a half in a closed penal facility.
Thus, the court hearing was delayed until May 19, 2014, 12 p.m.
