Mashtots Avenue protester Tonoyan’s representative motioned to partially suspend the case proceedings

Tonoyan’s counterclaim.
The police demand that the protester is held liable under Article 180.1(11 and 15), RA Code of Administrative Offences. And G. Tonoyan’s representative Tatevik Siradeghyan, lawyer at the Yerevan Office of HCA Vanadzor, demands that the police actions are considered unlawful.
When presenting the substance and grounds of the claim, RA Police representative Sona Melikyan, Senior Legal Adviser to Kentron Division of RA Police Yerevan city Department, mentioned that during the assembly of March 24, 2016, G. Tonoyan obstructed the normal course of the assembly and disobeyed the legal orders of the police. As evidence, she invoked the materials of the administrative proceedings and the videos published by the mass media presented to the court.
G. Tonoyan’s representative objected to the claim and mentioned that G. Tonoyan’s action had no elements of the act attributed to her.
Since no report on any offence under Article 180.1(11), RA Code of Administrative Offences was drafted at the police department and no such report was submitted to the court, T. Siradeghyan motioned to suspend the proceedings on that part. The Court will consider the motion later.
T. Siradeghyan also presented the grounds for the counterclaim. She noted that the police actions violated the protester’s right to liberty and security of person, freedom of movement, right to be free of torture, inhuman and degrading treatment, freedom of expression, and freedom of assembly as prescribed under the RA Constitution and the European Convention on Human Rights. She invoked as evidence statements from the mass media publications and videos submitted to the Court before.
After asking questions the parties, the Court set October 16, 2017 as the date of trial examination. The court hearing is scheduled for 2։30 pm.
