HCA Vanadzor’s recommendations to RA Prosecutor General
14:06, October 31, 2016 | News, Own news | General Prosecutor's Office of ArmeniaOn October 13, 2016, HCA Vanadzor submitted the recommendations below in frames of the workshop held by the RA Prosecutor General’s Office to discuss the possible directions of the cooperation with NGOs:
– ensure application of uniform terminology in the legal acts regulating the activities of the prosecutor’s office;
– prescribe separately the minimum criteria for a person to be appointed or nominated to a Prosecutor General’s office;
– define clearly the cases when the prosecutor is competent to withdraw the accusation and the cases when he/she is required to do so;
– lay down Article 27(2)(5) of the RA Law on Prosecutor’s Office as a separate part of the said article;
– lay down the Prosecutor’s duty, in case of initiating a claim for protection of the state interests, to warn the person responsible for causing damage to the state interests about voluntarily compensation of the damage every time before initiating such a claim;
– specify the guarantees for the prosecutor’s independence throughout his/her activities. For the purposes to ensure the supervising prosecutor’s independence, abolish the superior prosecutor’s right to appeal as well as withdraw the appeal filed by the prosecutor;
– specify the scope of control over the activities of prosecutors in the RA prosecution system;
– prescribe definition of the term “prosecutor’s official duties”;
– set up by RA Prosecutor General’s order a group of public observers to exercise state control over persons, visit various institutions (penitentiary facilities and institutions, armed forces, psychiatric hospitals, special educational institutions, care centers (nursing homes, children’s homes, boarding schools, etc.), police stations and internal troops, investigative bodies, detention facilities, etc.) to carry out monitoring and submit reports on the human rights situation;
– bring the legislation regulating the activities of the RA Prosecutor’s Office into compliance with the United Nations Basic Principles on the Role of Prosecutors;
– ensure monitoring of the activities of the prosecutor’s office by NGOs.
