Trial on the Case of the Dead Soldier’s Case Witness Detained for 10 Days Proceeds

Petrosyan, proceeded the hearing on the complaint by Artur Sakunts representing Meruzhan Kaleyan. Note that the RA Criminal Court of Appeal examines the legality of the judicial act by the First Instance Court of Syunik Marz (Region), RA dated September 22, 2014. At the previous hearing of the complaint examination, the judge had provided the complainant with the materials of the dismissed criminal case, and the court hearing was postponed, so that he could familiarize himself with the materials.
Avetisyan, investigator at the First Garrison Investigation Department, RA Ministry of Defense, responsible for the proceedings, again failed to attend the hearing of December 25, 2014. According to the presiding judge A. Petrosyan, the court had duly notified the investigator of the place, date and time of the court hearing, but received no information on whether he got the notice from the postal service.
Compainant A. Sakunts, representative of M. Kaleyan, considered it essential for the investigator responsible for the proceedings to attend the examination of the complaint and therefore, filed a petition to adjourn the hearing, notify N. Avetisyan again and ensure his presence at the next hearing with the help of his superior authorities.
Upon considering the petition above, the Court approved it and ruled to adjourn the examination of the complaint till 4 pm, January 21, 2015.
Note that during the proceedings of the criminal case regarding the serviceman Hayk Kaleyan’s death, the witness Armen Bozoyan claimed having been detained with 3 other witnesses at the military police for over 10 days, suffering beatings, violence and being forced to write down the testimonies as dictated by the investigator. A crime report was filed in terms of this statement, but the criminal proceedings were actually discontinued.
