Was a case initiated based on information published by Wikileaks?
00:00, September 13, 2011 | News | Freedom of Information and SpeechOn August 13, 2011, referring to an article published by Wikileaks “Members of the Constitutional Court were Subjected to Pressure after Hearing Ter-Petrosyan’s Claim,” Helsinki Citizens’ Assembly-Vanadzor submitted an inquiry to the RA Special Investigation Service and sent a copy to the RA Prosecutor General.
The article states: ‘…On March 6th, late at night, Valeri Poghosyan, Member of the RA Constitutional Court secretly contacted the (American)Ambassador, requesting a meeting in his house. The Judge stated that President Robert Kocharyan had already made a decision about the outcome of the scheduled March 8th meeting regarding the claim of the presidential candidate, Levon Ter-Petrosyan. Poghosyan stated that he personally was pressured from the Presidential Palace, and that his colleagues had also been intimidated….’
HCAVorganization mentioned in the inquiry that according to the RA Criminal Code a statement in mass media can also be a reason for initiating a criminal case, thus it requested the following information:
• Whether a case was initiated based on the information published by Wikileaks
• If yes, under which article of the RA Criminal Code?
• What investigative activities have been undertaken so far?
• If a case has not been initiated, what is the reason and the legal justification?
The inquiry submitted to the RA Special Investigation Service is attached to the Armenian version.
