Responding party: deputy prosecutor of Lori region, “The investigator couldn’t address all of the articles while issuing the ruling”
12:38, June 24, 2013 | Press Release | Freedom of Information and Speech, Right to Fair TrialThe court trial of the appeal over the case of attack against HCA Vanadzor representative versus Lori region Investigation Division of the RA Police General Investigation Department was held on June 19, 2013 at the RA Lori region Court of Common Jurisdiction.
It should be noted that during the previous court hearing HCA Vanadzor representative K. Tumanyan presented the Organization’s claim, whereas the responding party submitted a motion, whereby requesting additional time to get familiarized with the materials in order to present their disposition. While presenting his standpoint during the trial, Deputy Prosecutor M. Movsisyan referred that HCA Vanadzor Chairperson Artur Sakunts had reported on a crime over damaging the Organization’s property and inflicting bodily injury to the Organization’s staff member regarding which the investigator prepared materials but due to absence of crime no criminal case was lodged.
To the question of Organization’s representative K. Tumanyan why the investigator didn’t consider Article 162 of the RA Criminal Code (“Establishment or management of a religious or non-governmental association, whose activities inflict damage to the health of individuals, or with encroachments on other rights of individuals, as well as, incite citizens to refuse form their civil duties is punished with a fine in the amount of 200 to 400 fold of the minimum salary, or with arrest for maximum term of up to 3 months) during the preliminary investigation, M. Movsisyan explained that the investigator couldn’t address all of the articles while issuing the ruling. The responding party also stated that the attack hadn’t been previously planned, while the signature collection was organized offhandedly during the assembly.
HCA Vanadzor representative K. Tumanyan objected by noting that the incident had been planned and the video recording provided to the court by the Organization testified about it.
A new court hearing was scheduled at 12:00 p.m. on June 28 of 2013 by the court in order to get acquainted with the materials.
