Case on Threats Against Zaruhi Postanjyan in RA Criminal Court of Appeals

Ghazaryan started hearings of the appeal by Artur Sakunts, Chairman of HCA Vanadzor, against the ruling of March 4, 2014 by the Court of General Jurisdiction of Kentron and Nork-Marash administrative districts of Yerevan, Republic of Armenia. Note that by the ruling in above the court of first instance rejected the demand to reverse the RA SIS investigator M. Babayan’s ruling of October 31, 2013 on dismissing a criminal case. The latter had previously dismissed the appeal to initiate a criminal case based on the threats against NA Deputy Zaruhi Postanjyan and her relatives by the RA Deputy Minister of Sport and Youth Affairs and Chairman of ‘Hayots Artsivner’ NGO Khachik Asryan. The investigator substantiated his dismissal by the fact that the treats were grounded only by media publications.
On April 22, 2014, the authority in charge of the case proceedings and the supervising prosecutor missed the hearing, but had previously noticed the Court on their approval of the legal analyses in the ruling by the Court of General Jurisdiction of Kentron and Nork-Marash administrative districts of Yerevan, Republic of Armenia, considering it lawful. They also informed the court on holding the hearing in their absence.
The applicant Artur Sakunts petitioned to provide the presence of the authority in charge of the case proceedings and a representative of the General Prosecutor’s Office.
The presiding judge K. Ghazaryan delayed the consideration of A. Sakunt’s motion and publicized the judicial act by the Court of General Jurisdiction of Kentron and Nork-Marash administrative districts of Yerevan. Thereafter, the applicant A. Sakunts presented the legal groundwork of his appeal and insisted on the motion to provide the presence of the other party at the hearings.
The judge upheld the motion and postponed the court hearing until 2 p.m. May 5, 2014.
