Court hearing on ArmenTel CJSC v. S. Gh. adjourned
16:36, January 25, 2016 | News, Own newsOn January 25, 2016, the General Jurisdiction Court of Lori Region (Marz), presided by judge B. Grigoryan, held a next-in-turn hearing on ArmenTel v. S. Gh.
The court hearing was attended by S. Gh.’s representative Arayik Zalyan, HCA Vanadzor Legal Department Coordinator.
Presiding judge B. Grigoryan stated that due to S. Gh.’s health problems, the Court allowed the defendant party to reveal with the help of police the circumstances of signing the contract. However, according to A. Zalyan, the competent authorities decreed to decline initiation of criminal proceedings. On September 15, 2015, S. Poghosyan, Senior Investigator at Bazum Division, RA Police Lori Marz (Region) Vanadzor Department, decreed to decline initiation of criminal proceedings. A few days later, on September 18, 2015, the Organization applied to the RA Lori Marz (Region) Prosecutor’s Office to annul the decree above. Later on September 28, 2015, the RA Lori Marz (Region) Prosecutor’s Office decreed to dismiss the appeal. Afterwards, on October 10, 2015, HCA Vanadzor applied to the General Jurisdiction Court of Lori Marz (Region) to stop violation of S. Gh.’s rights and freedoms and submit the case to preliminary investigation. Having examined the application, on November 17, 2015, the court ruled to dismiss it. On December 4, 2015, the Organization appealed the ruling above to the RA Court of Criminal Appeal. Since the ruling of the Court of Criminal Appeal has not been received yet, presiding judge B. Grigoryan ruled to adjourn the court hearing till February 24, 2016, 10:10 am.
Note that ArmenTel CJSC filed a claim with a court of law against S. Gh. on seizing due amounts. According to the lawsuit, S. Gh. had signed a sale and purchase contract with the Company, under which it was bound to make payments, but he made no such payments.
According to S. Gh., he had signed no contract with the Company above and had never seen the personal computer making the subject matter of the contract; moreover, he had no computer and Internet skills.
It is also noteworthy that according to the data in the reference provided by the RA Lori Marz (Region) Psycho-Neurologic Dispensary, S. Gh. is registered with the Dispensary.
