Material damage compensation demanded from the teacher who caused injury to the student’s eye
17:12, June 1, 2017 | News, Own newsOn May 30, 2017 the General Jurisdiction Court of Gegharkunik marz (region) resumed examination of the material damage compensation claim under Mesrop Khachatryan’s case who lost one of his eyes and eyesight because of teacher’s actions.
Note that a 13-year-old student at Sevan town high school had one of his eyes damaged at the Physics lesson on December 9, 2014. Under the initiated criminal proceedings, charges were brought against teacher Hasmik Margaryan under Article 120(1) /causing serious damage to health through negligence/ of the RA Criminal Code.
On April 25, 2016 the General Jurisdiction Court of Gegharkunik marz (region), RA, found her guilty and fined her in the amount of 200-times the fixed minimum wage.
After the victim’s representative Ani Chatinyan, lawyer at HCA Vanadzor, appealed the ruling, the RA Court of Criminal Appeals partially reversed the ruling and sent the case to the lower court for re-examination of the claim to confiscate in favor of the aggrieved party from defendant Hasmik Margaryan and the RA Ministry of Education and Science 16.400.000 AMD as material damage caused through the offence.
At the court hearing of May 30, 2017 the aggrieved party submitted the civil claim and evidence and motioned to question the attending doctor.
The motion will be considered at the court hearing scheduled for June 12, 2017, 11 am.
