Medical and Social Expert Examination Agency granted the complaint of the woman not granted disability degree in the 8th year
16:19, August 2, 2017 | News, Own newsHelsinki Citizens’ Assembly-Vanadzor carries on protecting the rights of the persons denied disability degree without any grounds after the next-in-turn medical and social expert re-examination.
Since 2011, Zh. Ch. was granted 3rd disability degree for 7 consecutive years. But in the 8th year, no disability degree was granted after the next-in-turn re-examination. Moreover, the Commission gave no explanations on the reasons for granting no disability degree.
Zh. Ch.’s health problems are caused by arterial pressure fluctuations. She is under constant medical surveillance. This is evidenced by the epicrises given by medical facilities. While in the recent 8 years, there were no positive changes in the woman’s health, the members of the medical and social re-examination commission did not pay any attention to it and arbitrarily decided not to grant her any disability degree.
Based on the provisions of the RA Law on Fundamentals of Administration and Administrative Proceedings, Zh. Ch. appealed, with the support of HCA Vanadzor, the decision of the commission that conducted the medical and social expert examination. In her appeal, Zh. Ch. presented grounds that the Commission violated the provisions of the above law and denied granting disability degree without any impartial examination.
Some days ago, the RA Medial and Social Expert Examination Agency granted the complaint and annulled the medical and social expert examination commission’s decision on not granting any disability degree.
The issue on granting Zh. CH. disability degree will be revised.
