Hearing on examination of appeal under Karen Kyupelyan’s case adjourned again

Melkonyan, started examination of the appeal of Karen Kyupelyan’s representative Tatevik Siradeghyan, HCA Vanadzor lawyer. By the appeal above, T. Siradeghyan required to annul RA SIS Senior Investigator for High-Profile Cases A. Ohanyan’s decree of October 19, 2015 on not initiating criminal prosecution.
The hearing was attended by plaintiff K. Kyupelyan, his representatives Artur Sakunts and T. Siradeghyan, and Ashot Ohanyan responsible for the investigation.
Upon identifying the parties and making sure there were no motions for challenges, the Court asked why the agency responsible for the investigation had not submitted to the court the case files. A. Ohanyan, SIS Senior Investigator for High-Profile Cases, answered that based on the charges under the criminal proceedings initiated, an indictment was issued against H. M., former RA SIS officer, and the case was submitted to the court. Also, the preliminary investigation files of the criminal proceedings were submitted to the relevant court and therefore could not be submitted to the Court in question.
The Court compelled A. Ohanyan to submit the criminal case files by mentioning that the agency responsible for the investigation was under such an obligation.
Hence, the examination of the appeal was adjourned till February 29, 2016, at 2 pm.
Note, that the appeal filed by K. Kyupelyan’s representative was first admitted by judge A. Khachatryan, who was subsequently transferred to another court. During the court hearing, judge A. Khachatryan compelled the agency responsible for the investigation to submit to the Court the preliminary investigation files which had not been submitted for the same reasons.
