Court ruled to restore violated rights of Rustam Ghazaryan
20:15, December 25, 2015 | News, Own news | Rights of PatientsAs already reported, on December 23, 2015, the General Jurisdiction Court of Avan and Nor-Nork Administrative Districts upheld the claim filed by Rustam Ghazaryan and his representative Tatevik Siradeghyan, HCA Vanadzor Yerevan Office lawyer against the Republican Narcological Center CJSC to cancel his registration with the Center as a drug user and remove all the relevant medical records.
In the ruling justifications, the Court held among others that according to the RA Government Decree № 1599-N on Establishing Procedures for Medical Observation and Registration of Drug Users dated December 20, 2007, a person shall be registered as a drug user on the grounds below: medical examination of the person revealing the disease of drug addiction and the diagnosis by physician-narcologist. Whereas, in this case, Rustam Ghazaryan was registered without any relevant medical examination and any diagnosis by a physician-narcologist.
Given that registration with a narcological medical institution limits plaintiff’s access to certain rights, the Court ruled to restore the violated rights of Rustam Ghazaryan by canceling his registration as a drug user with the RA MoH Republican Narcological Center CJSC and removing all the relevant medical records.
