Poghosyan, resumed examination of the case on accusation of abuse of powers by Hrant Mazmanyan, former officer at the RA National Security Service.
Note that H. Mazmanyan was charged with keeping Karen Kyupelyan, victim of the case, at the administrative premises of the RA NSS at the night on November 2, 2007, i.e. with baseless restriction of K. Kyupelyan’s liberty.
At the previous court hearing of this case, the Court questioned victim K. Kyupelyan and defendant H. Mazmanyan. Then, at the stage of considering motions on additional evidence, the court hearing was adjourned by the defendant’s request to involve an attorney.
The court hearing of January 25, 2016 was attended by the prosecutor A. Shahbazyan, affected party K. Kyupelyan, his representative Tatevik Siradeghyan, HCA Vanadzor Yerevan Office lawyer, and defendant H. Mazmanyan. The court hearing was also attended by lawyer Tanya Hakobyan who was involved as H. Mazmanyan’s attorney.
T. Hakobyan motioned to additionally question the defendant and the victim to find out when exactly the officers of higher rank as compared to H. Mazmanyan had left the administrative premises of the RA NSS on the day in question. During the additional questioning, victim K. Kupelyan mentioned that E. Nanyan and T. Aghajanyan, superior officers who ordered H. Mazmanyan to keep an eye on him, had left the premises between 12 and 12:03 am. In response to the questions of his attorney, H. Mazmanyan mentioned that if he had released K. Kyupelyan, he would have been subjected to disciplinary liability and even dismissed from his office.
The other parties to the trial and the Court also asked the victim and the defendant several questions to clarify the situation. T. Hakobyan, attorney of defendant H. Mazmanyan, filed another motion on additional evidence requesting the Court to involve E. Nanyan and T. Aghajanyan in the case as witnesses and question them. Prosecutor H. Shahbazyan requested the Court to grant the motion partially and involve as a witness only T. Aghajanyan. As for T. Siradeghyan, representative of the victim, she fully approved the motion and emphasized that at the previous hearing, the aggrieved party had submitted a similar motion. The Court ruled to uphold the motion partially and question T. Aghajanyan, RA NSS former officer, as witness of the case. The participants to the trial submitted no other motions. Hence, the court hearing was adjourned and scheduled for February 16, 2016, 9:30 am.
