No health provider involved as accused under the case on providing inadequate medical care to the convict who died at hospital
16:58, May 31, 2017 | News, Own news | Right to an Effective Remedy of Legal Protection | Detention FacilitiesOn May 29, 2017 the General Jurisdiction Court of First Instance of Erebuni and Nubarashen administrative districts of Yerevan city, RA, resumed examination of the complaint under the case of convict Serob Gevorgyan who died at ‘Erebuni’ Medical Center on April 27, 2015.
On April 20, 2015 S. Gevorgyan, convict at ‘Nubarashen’ penitentiary facilities, committed self-injury and was taken to hospital only some days later and died there.
Later, the criminal proceedings initiated by the RA Investigative Committee under Article 130 of the RA Criminal Code were suspended on the grounds that the person to be involved as the accused was not identified. T. Siradeghyan, representative of the victim’s successor and lawyer at Yerevan office of HCA Vanadzor, appealed before the court the investigator’s decision on suspending the proceedings.
At the court hearing, T. Siradeghyan noted that Article 130 of the RA Criminal Code entails responsibility for medical care and service providers and requires that consequences of their actions are available. The adequacy of the medical care may be determined by a commission forensic medical expert examination, but the investigating body decided to suspend the criminal proceedings on the day when the commission forensic expert re-examination was assigned, without waiting for its findings. She noted that by doing so, they violated the victim’s right to an effective legal remedy and demanded that the Court eliminated the violation.
G. Matevosyan, Senior Investigator at the Investigative Division of Erebuni and Nubarashen administrative districts of Yerevan City Investigative Department, RA Investigative Committee, responsible for the proceedings, did not attend the court hearing because of taking part in an urgent investigative action.
The Court found it necessary to hear his position as well and postponed the court hearing.
The hearing will be held on June 15, 2017, 10: 30 am.
