The Police have refused to replace the lost driving license on the pretext of the owner being under investigation by The RA Compulsory Enforcement Service. The issue has been resolved with the support of HCA Vanadzor
16:01, November 10, 2017 | News, Own news | PoliceOn November 4, 2016 Seyran Babayan applied to Vanadzor Records and Examinations Subdivision of the RA Traffic Police with the purpose of receiving a replacement driving license. However, he was denied.
The denial of a new license was substantiated by the fact that the citizen was under investigation by the RA Compulsory Enforcement Service and that the replacement driving license would be provided only upon termination of the investigation.
In order to find a solution to the problem, S. Babayan turned to HCA Vanadzor.
With an application addressed to A. Sargsyan, the Head of Vanadzor Records and Examinations Division of the RA Traffic Police, HCA Vanadzor indicated that the denial of a replacement driving license on the basis of the citizen being under investigation by the Compulsory Enforcement Service was unlawful for the Law does not prescribe such grounds for denial.
In particular, under Article 71 of the RA Government decision on “the procedure of administering examinations for obtaining a driving license and issuing a driving license, the list of the documents that are to be submitted in order to receive a driving license as well as the provision of the samples and descriptions of national and international driving licenses”, being under investigation by the Compulsory Enforcement Service is not secured as a basis for denial. Therefore, the decision of Vanadzor Records and Examinations Division of the RA Traffic Police is not lawful.
With this application, HCA Vanadzor demanded to re-establish S. Babayan’s violated rights and to hold the offender accountable.
Up to now, there has been no written response to the application submitted by the Organization on August 28, 2017. Yet, S. Babayan informed that he had received his replacement driving license.
As for the demand to hold the offenders accountable, HCA Vanadzor has not been provided with any information regarding this.
In regard to the proceeding of the application, the Organization has made an additional enquiry to Y. Karapetyan, the Head of the RA Traffic Police.
