Court dismissed appeal on Rustam Ghazaryan’s case
12:01, July 27, 2015 | News, Own newsOn July 24, 2015, the RA Administrative Court, presided by Judge M. Melkumyan, announced the judicial act on the case of Rustam Ghazaryan. Upon examining in an open hearing the administrative case R. Ghazaryan v RA Ministry of Health, following the application of dropping him from the register at the Ministry of Health Republican Narcological Center CJSC, the Court ruled to dismiss the application above. The Court supported its ruling by the grounds that the Ministry of Health had no authority to drop a person from the register of relevant medical facilities. At the same time, given the lack of the authorities above of the Ministry of Health and the fact that the administrative case on the account of the requirement to declare illegal the act of registering the person with the medical facilities was discontinued, the Court failed to consider the arguments in the application on the legality of registering a person as a drug user. Note that R. Ghazaryan was registered with the narcological medical facilities upon the opinion of a toxic and chemical expert examination conducted within the criminal case, without the relevant examination and diagnosis by a physician-narcologist.
