HCA Vanadzor filed suggestions on the draft laws submitted by the RA Human Rights Defender
18:31, September 14, 2017 | News, Own newsOn July 3, 2017 the RA Human Rights Defender’s Office applied to HCA Vanadzor seeking its suggestions and comments on the draft RA Law on Making Amendments to the Criminal Procedure Code of the Republic of Armenia, draft RA Law on Making Changes and Amendments to the RA Law on Treatment of Arrestees and Detainers and on the draft RA Government Decree on Making Changes in the Decree of the Government of the Republic of Armenia № 1543-N of August 3, 2009.
Note that the said drafts are not posted on the RA Justice Ministry’s unified website for publication of draft legal acts.
The legislative draft package developed by the RA Human Rights Defender aims to guarantee the detainee’s right to meet their close family and legal representative.
Based on an analysis, HCA Vanadzor expressed its position that the legislative changes should target the national regulations ensuring the rights to communicate with the outside world not only for the accused but also for suspects and convicts.
The issue identified by the RA Human Rights Defender is split into other legal issues that are not limited to the legal status of detainees only. The key objective is to ensure the right to communicate with the outside world for persons deprived of liberty at pre-trial stage and stages of trial proceedings and trial execution.
HCA Vanadzor made suggestions on the guarantees to ensure the right to visits for persons deprived of liberty and the legal consequences of limitations during their imprisonment in isolation cells. The Organization considers it necessary to make amendments to the current legislation to lift the unjustified limitations on the rights and degrading treatment of detainees during their stay in isolation cells. The Organization also touched upon the differentiated regulations of the convicts’ right to communicate with the outside world set by the RA legislator suggesting that the level of prisoners’ communication with the outside world is determined by the type of sentence imposed on them in the judgment and the mode of serving such sentence.
In September 8, 2017 HCA Vanadzor submitted its suggestions to the RA Human Rights Defender.
