RA Criminal Court of Appeals Ruled the Case on Threats against Zaruhi Postanjyan

Ghazaryan proceeded the hearing on the appeal by HCA Vanadzor Chairman Artur Sakunts against the ruling of March 4, 2014 by the Court of General Jurisdiction of Kentron and Nork-Marash administrative districts of Yerevan, RA on the case of threats by Khachik Asryan against Zaruhi Postanjyan and her relatives. Note that the previous hearing was delayed to provide the presence of the authority in charge of the case proceedings and a representative of the General Prosecutor’s Office.
However, representatives of the RA Special Investigation Service and the General Prosecutor’s Office did not attend the trial again and had previously submitted a letter to the Court to process the complaint in their absence. Particularly, N. Stepanyan, senior officer at the Staff Secretariat of the RA General Prosecutor’s Office informed the Court that the senior prosecutor V. Badalyan had already notified the Court of his absence due to heavy workload. N. Stepanyan added that V. Badalyan had already stated his position on the appeal of A. Sakunts requesting the Court to dismiss it and finding the judicial act passed by the Court of General Jurisdiction of Kentron and Nork-Marash administrative districts of Yerevan, RA on March 4, 2014 legal, well-grounded and reasonable.
M. Babayan, Deputy Head of the RA Special Investigation Service, had notified the Court that the representatives of the investigative authority were unable to attend the trial due to their heavy workload and requested the Court to consider their absence justified by a reasonable excuse and process the appeal in their absence.
HCA Vanadzor Chairman Artur Sakunts defined such attitude as a degrading treatment towards the judicial system and motioned the Court to require clear evidence of their heavy workload.
Upon considering the motion, the presiding judge K. Ghazaryan rejected it on the basis that the Court had sufficient evidence to rule on the case.
The presiding judge left to the retiring room to make the ruling and after a few minutes declared its final part. Accordingly, the Court dismissed the appeal of HCA Vanadzor Chairman Artur Sakunts, and the judicial act of the lower court remained effective.
The ruling of May 5, 2014 by the RA Criminal Court of Appeals will be presented upon its receipt.
