On December 19, 2014, the RA Administrative Court, presided by judge G. Sosyan, held another preliminary hearing on the application by the spouses Ashot Khudoyan and Heghine Makaryan against the RA Police.

Note that at the previous preliminary hearing, the judge had approved in part the petition of Tatevik Siradeghyan, plaintiffs’ representative, on recognizing the evidence and ruled to hold another preliminary court hearing to question the witnesses.

However, the witnesses failed to attend the preliminary hearing in question, and according to the court, the notifications were duly sent to the plaintiffs at the addresses mentioned in the petition. The plaintiffs’ representative stated that she had provided the right addresses and was unaware of the reasons why the witnesses failed to appear before the court. At the hearing, the plaintiff party also stated that after the previous preliminary hearing of this case, an unknown woman visited the witness Vahag Simonyan at his place, introduced herself as A. Khudoyan’s advocate, with no mention of her name and asked to present to the court the information on the case available to him. The plaintiffs’ representative also added that neither she, nor any other representative of the plaintiff party had visited Vahag Simonyan.

The court proposed the parties to express their opinions on proceeding to the trial phase of the case. The representative of the plaintiff party did not object, and Martha Melkonyan, representative of the RA Police, considered that the questioning of the witnesses was not necessary and the court could proceed to the trial stage.

The plaintiffs’ representative T. Siradeghyan mentioned that the presence of the witnesses was of critical importance for the outcome of the case, and therefore, the court had approved the petition on questioning and involving them as witnesses. The presiding judge Sosyan stated that the witnesses would be questioned at the trial stage, and the court would take the necessary measures to ensure their presence. The plaintiffs’ representative produced another proof in the court. Particular, T. Siradeghyan presented to the court the response of the RA Police Law Department to the inquiry of Artur Sakunts, Chairman of the HCA Vanadzor, which provided the names and surnames of all the police officers found in the video record submitted to the court. Also, T. Siradeghyan considered it necessary to read out the information provided in the letter of the RA Police Law Department, according to which, the police carried out explanatory activities with A. Khudoyan,  and as a result the family returned home of their own free will, without any force exerted by the police.

Thus, the court considered the case ready for the trial, and a relevant ruling will be made in due time.
