Mataghis Case is Getting Complicated
00:00, March 31, 2011 | Press Release | Right to Fair Trial, Right to Life, Rights of Soldiers/Recruits | Armed ForcesThe trial of a criminal case over a murder committed in 2003 in the Mataghis Military Unit, resumed at Shirak District Court of First Instance.
Three former military servicemen, Razmik Sargsyan, Arayik Zalyan, and Musa Serobyan are charged with the murder of two fellow soldiers, Roman Yeghiazaryan and Hovsep Mkrtumyan. After three years’ imprisonment they were released under a Cassation Court’s decision while the case is currently subject to preliminary investigation.
Later the Constitutional Court reached a decision that the Court of Cassation has no right to send the case for additional investigation. And since the plaintiff party hasn’t changed its disposition after the verdict, a criminal case was again filed against the 3 defendants. The latter don’t admit their guilt. During the previous court session, Hovsep Mkrtumyan, the victim’s father, was claiming that he made a phone call to a fellow driver on December 2004 from his neighbor’s place. The latter informed him that Hovsep and the other co-serviceman were identified and were located at Military Police Department. The accusing party wanted to be sure that the incident had occurred as described; therefore, the victim’s successor submitted a solicitation to the Court to invite his neighbors as witnesses with whom he had shared the good news.
Witness Arshak Harutyunyan notified the Court that he had been to Movses Mkrtumyan’s place, while the latter went to their place to make a phone call in order to get news from the boy. “He told me he had good news from his son stating that he was found at Military Police Station. The good news was that a few days ago they claimed the boy could not be found. Now they were happy over their son being safe and sound”, said Arshak Harutyunyan. The witnesses were unaware of additional details.
Later the next witness Garik Karapetyan, Mkrtumyan’s neighbor, was invited into the court room. He could recall that they had called a military serviceman called “Sasha” to get news about Hovsep on December 31, 2004. The witness claimed they questioned him about “certain” Hovsep Mkrtumyan.”We called some friend on December 31 and got informed that the boy was missing. The latter contacted a source and identified that the boys were at the Police Department. Later on January 2, Movses stated the boys were once again missing”, says Garik Karapetyan.
They contacted Sasha and were informed that there had been misinformation and now confirmed the boys in the police custody were different soldiers.
In order to get detailed information about the phone call made from Harutyunyan’s house, Hayk Alumyan, the defendant’s advocate, invited Tereza Hakobyan into the court room.
This time Mari Melkumyan appeared as the successor of the other murdered soldier Roman Eghizaryan. During the upcoming sessions, she will be replaced by her son’s uncle Artur Eghiazaryan, who is currently at migrant work.
According to the woman’s notification, she needs 20 days to get acquainted with the case details.
The next court trial was appointed on April 21.
