Ivan Grigoryan, Karlen Mayilyan, Mishik Arzumanyan… these are people to be summoned to the Court. The Mataghis case re-starts
13:53, October 24, 2013 | News | Right to Fair Trial, Right to Life, Rights of Soldiers/Recruits | Armed ForcesToday the parents of Hovsep Mkrtumyan, the victim over the Mataghis case, who was murdered in 2004, came to Gyumri Military Police to get acquainted with the progress of the new preliminary investigation over their son’s murder.
After December, 2012, when the verdict of Gyumri Court of Common Jurisdiction was promulgated, whereby, the 3 defendants were acquitted, the relatives of one of the victims Hovsep Mkrtumyan submitted a new claim to the RA Military Prosecutor’s office to actually begin a new investigation over the case.
In an interview with GALA, Hovsep Mkrtumyan’s mother Greta Mnatsakanyan noted that this time they hoped that after 10 long and hard years the murderers of their son, the real criminals, would be identified and would appear before justice.
“My son died on January 9, 2004, thus, that day he was taken out of water beaten to death and murdered. During all these 10 long and hard years a wrong investigation over the case was underway, 3 innocent young men were being convicted, moreover, they were confined to life sentence, and finally they were acquitted: a just verdict was reached on December 18, 2012. Now those guys are enjoying freedom, but we demand justice, so that the true perpetrators get punished. Now the preliminary investigation is underway, we’ll see how it ends up. Not long ago we were talking with the investigator, we had the feeling that they were also thoroughly investigating the case, according to them; they were very determined to have it the right and just.”
Mrs. Greta said she was convinced that all those who manoeuvred and did not appear before the Court during the previous court trial will answer before the law.
“When the acquittal verdict was reached in December, the mother and uncle of the next victim Roman Yeghiazaryan, who were his legal successors appealed against the justice and until the end they claimed that the 3 servicemen in the court were the perpetrators, they still claim they are guilty and must answer for that. They appealed to the Court of Appeals, they were again denied, and the young men were acquitted. As far as I remember, the case was not at all taken into trial at the Cassation Court. After that we submitted an appeal to the RA Military Prosecutor’s office to begin an additional investigation and identify the true criminals. I feel it in my bones that this time the justice will be revealed, they would not protract it this long, I am sure that the real perpetrators and criminals are wandering in freedom. This case is of international importance. It seems to me that at least once justice will win.
We were until present unable to summon Ivan Grigoryan from the commanders’ staff to the Court, who was their commander. Even if he was not guilty in anything, he should have come and appear, he would come for the sake of the two of the soldiers. He had with him Karlen Maylyan, Mishik Arzumanyan, who had sent Kim Baghuryan to our place as if the children had disappeared and he had come to look for them in our places, why none of them appeared before the court?
What deal was that, I did not understand what they were concealing and hiding? It is obscure for us, everybody should answer and justice will win. I hope we will win this time”, stated Mrs. Greta, the mother of deceased soldier Hovsep Mkrtumyan.
It is worth noting that today advocate Hayk Alumyan also accompanied the Mkrtumyans to Gyumri, who was the advocate of the 3 acquitted convicts.
“We got acquainted with the trial conducting body officials and we realized we had to deal with conscientious officials. We hope that through this case we will be able to reveal the truth and subject the real perpetrators to liability. At least we got quite hopeful when we talked with them. There are many details about which we cannot voice now. As much as we talked to them, we are pleased”, stated Hayk Alumyan after he came out of the Military Prosecutor’s office.
To the question of GALA how Hayk Alumyan will protect the aggrieved party if he presented the interests of the defendants in the Mataghis case, the advocate replied,
“I am entitled to present the aggrieved party, if all of my 3 defendants give their consent, now they have all agreed. I must also confirm that initially there were no substantial differences between our dispositions, we claimed that those 3 defendants had no relation to the murder, Hovsep Mkrtumyan’s parents also claimed they had no connection with the crime. We shared the same opinion and still continue doing it. And I did not reject when the victim’s parents turned to me for legal assistance”.
