Conscript R. D.’s right to education restored

D. consulted Helsinki Citizens’ Assembly Vanadzor for protection of his rights stating that despite a number of health problems he was declared fit for military service without any due medical examination.
In terms of the issue at stake, HCA Vanadzor submitted a letter to RA Ministry of Defense to review the legality of the conscript’s fitness to military service and grant him deferment, if necessary.
By disagreeing with the medical opinion on his health, the conscript refused to be drafted in the army and consequently, the military commissariat by its notice did not permit him to continue his studies at a higher educational institution.
By its letter of February 9, 2016, the Organization applied to both the RA Ministry of Education and Science and the RA Ministry of Defense arguing that the ban imposed on R. D. on continuing his studies by the letter of the military commission was illegal and did not comply with the RA Constitution and other legal norms, and therefore, in this case R. D.’s right to vocational education was violated illegally.
By its letter of March 4, 2016, the RA Ministry of Education and Science stated that R. D. was allowed to attend classes.
In fact, the administration of the higher education institution, ignored the right to education enshrined in the RA Constitution, and prohibited illegally the student from continuing his studies only based on the notification of the military commissariat.
