On June 8, 2017 the General Jurisdiction Court of Kentron and Nork-Marash administrative districts started examination of the claim for material and moral damage compensation of G. Misakyan, successor to 2-year-and-3-month-old Lia Misakyan who died at ‘Arabkir’ Medical Center on January 2, 2013.

By their claim, G. Misakyan and his representatives, Arayik Zalyan and Ani Chatinyan, lawyers at HCA Vanadzor, demand seizing from ‘Arabkir’ Joint Medical Center – Institute of Child and Adolescent Health LLC and L. Vardanyan and Z. Ayvazyan, doctors at ‘Arabkir’ Medical Center, 15,000.000 AMD for moral damage and 1,690.000 AMD as material damage.

As the plaintiff party had not got yet the defendant party’s response to the claim, G. Misakyan’s representative Ani Chatinyan asked the Court to provide them with a copy of the response to the claim and asked for some time to get familiar with it.

As a result, the Court postponed the hearing till July 28, 2017, 11:30 am.

Note that by its judgment of December 22, 2015, the General Jurisdiction Court of Arabkir and Kanaker-Zeytun administrative districts of Yerevan city, RA, found Lilit Vardanyan and Zarine Ayvazyan, doctors at ‘Arabkir’ Medical Center, guilty under Article 130(2) /failure to fulfill or properly fulfill professional duties by medical care and service personnel, which caused through negligence the patient’s death/ of the RA Criminal Code and sentenced them to imprisonment of 2 years and 2 years and 6 months, respectively, without any additional sanction and released them by amnesty for the 22nd anniversary of independence of the RA.

On June 24, 2016 the RA Cassation Court partially dismissed the First Instance Court’s judgment and sent the case to the first instance court for re-examination on the part of imposing additional sanction.

The representatives of the victim’s successor also filed a complaint with the European Court of Human Rights.
