Neither the doctors nor the State accept their obligation to provide compensation for the violation of the right to life
On August 1, 2018, the General Jurisdiction Court of Yerevan resumed the examination of the claim for material and moral compensation submitted by the legal successor of two-year-and-three-month-old Lia Misakyan, who died at Arabkir Medical Center on January 2, 2013, and considered the trial completed.

The prosecutor and the aggrieved party demand to temporarily deprive the defendants in the case of young child Lia Misakyan of the right to work as a pediatrician
Today, on May 22, 2018, the aggrieved party and the prosecuting attorney in the case of two-year-and-three-month-old Lia Misakyan, who died at Arabkir Medical Center in January 2013, delivered their closing arguments at the Court of General Jurisdiction of Yerevan.

The case on young child Lia Misakyan was not supposed to be held; however, the aggrieved party was not informed
We certainly accept that technical issues could have arisen because of the creation of the Court of General Jurisdiction of Yerevan and the relocation of judges; however, they should not get in the way of ensuring of the participants’ right to a fair trial of a criminal case in a reasonable time. Yet, after the RA Court of Cassation additionally sent the ruling on this case for a new examination, Judge M. Melkonyan initiated proceedings on October 25, 2016, and the case is still being examined.

On September 5, 2017 a next-in-turn court hearing was scheduled on the case of 2-year-and-3-month-old Lia Misakyan who died in ‘Arabkir’ Medical Center in January 2013, after the RA Cassation Court sent the case to re-examination.
Compensation from the state budget or from doctors?
In the former, the representative of ‘Arabkir’ Medical Center stated that the damage was not caused by the fault of the Medical Center; it was not considered a public institution and should not provide any compensation in the sense of the RA Civil Code. Also, the Medical Center’s representative does not consider reasonable the amount of the moral damages and asks the Court to reject the claim.
Successor of Lia Misakyan who died at ‘Arabkir’ Medical Center in 2013 demands material and moral damage compensation from doctors
On June 8, 2017 the General Jurisdiction Court of Kentron and Nork-Marash administrative districts started examination of the claim for material and moral damage compensation of G. Misakyan, successor to 2-year-and-3-month-old Lia Misakyan who died at ‘Arabkir’ Medical Center on January 2, 2013.
By their claim, G. Misakyan and his representatives, Arayik Zalyan and Ani Chatinyan, lawyers at HCA Vanadzor, demand seizing from ‘Arabkir’ Joint Medical Center – Institute of Child and Adolescent Health LLC and L. Vardanyan and Z. Ayvazyan, doctors at ‘Arabkir’ Medical Center, 15,000.000 AMD for moral damage and 1,690.000 AMD as material damage.
