The Aggrieved Party did not Receive an Appealed Claim regarding Derenik Gasparyan’s case
00:00, June 3, 2011 | Press Release | Right to Fair Trial, Right to LifeOn June 2, 2011, the RA Criminal Court of Appeals heard the court trial of the case initiated by Kotayk Region Prosecutor General’s office against the resolution made by the Kotayk Region Court of First Instance.
During the trial the aggrieved party stated they had not received the appealed claim and were not familiar with the content of the claim. It also turned out that Kotayk Region Prosecutor General’s office had submitted a solicitation to the Kotayk Region Court of First Instance with a claim to reinstate the omitted deadline, about which the aggrieved party was also unaware.
Arayik Zalyan, advocate of Helsinki Citizens’ Assembly-Vanadzor, representative of the successor of the aggrieved party, submitted a solicitation to receive the case-related documents, including the appealed claim and the resolution taken by the Kotayk Region Court of First Instance.
The court satisfied the solicitation and postponed the court trial until June 7, 2011.
It should be noted that on March 18, 2011 Kotayk Region Prosecutor General’s office filed an appealed claim against the resolution of the Kotayk Region Court of First Instance regarding Derenik Gasparyan’s case to abrogate the resolution over the rejection to file a criminal case.
