“It was his fate to die, he died and nobody can do anything”
05:57, December 9, 2013 | News, Other news | Right to Fair Trial, Right to Life, Rights of Soldiers/Recruits | Armed ForcesThe court trial over the death case of 18-year old conscript, resident of Spandaryan village of Shirak region Hayk Khachatryan, who died on December 30, 2011 in “Nork” hospital for infectious diseases due to complication of chickenpox, is coming to an end. Most probably an amnesty act will be applied in relation to Minas Mkrtchyan and Mikael Mikaelyan, who are deemed defendants over this case. Officials Minas Mkrtchyan, head of Neurological Department of RA MoD # 14203 military unit, and Mikael Mikaelyan, head of Neurological Department of RA MoD Central Clinical Military Hospital had submitted a written motion to the judge to apply amnesty in relation to them. And as expected, during the forth-coming court session the judge will satisfy their motion.
Whereas, the parents, relatives and advocates of the diseased soldier have decided to boycott the court hearings: several court sessions in a row, today and hereinafter they will not attend the court hearings over this case. They are waiting for the court’s verdict to be able to apply to the European Court after exhausting all domestic remedies.
“The cynicism reached to the point that instead of exercising justice the judge sates that nobody was guilty in Hayk Khachatryan’s death that it was his fate to die, he died and nobody can do anything. Here goes the justice.”
Hayk Khachatryan’s father said they had one month before stated about boycotting the court hearings.
“We declared in the court that it was meaningless to attend the sessions, since there was neither law, nor order in the country. Instead of punishing the criminals the major criminal, who is the president of this county, has declared an amnesty. We have long before stated and left, it means we do not trust this country, the justice that we boycott their revelations”.
Movses Khachatryan said if he decided to attend the court hearings again, it will mean he consented to the tomfoolery and “acting” of their intention. Because of that he refused attending the court hearings.
“The country’s criminals are baking each other to have the case closed. They openly look into your eyes and tell lies, what else can I say. Why should I go there, everything is tomfoolery there, I feel uneasy. I will probably write a letter to Serzh Sargsyan, the head of this country’s criminals, who patronizes all criminals and end up with that. We must waiting until the verdict is delivered, then I will appeal the verdicts in all instances until the European Court.”
The father of diseased soldier is sure that an obvious crime was committed, his son was killed and the criminal are enjoying freedom.
“They killed my son openly torturing him, I know, I am present, this is not the case that they killed him secretly to term it a sudden death or a suicide. This is all absurd. And I am amazed how after all this I do not go insane or commit a suicide. Let them now do all they want, let them apply amnesty. I do not know what to say, the law does not function at all. They waited until the day of amnesty to play their roles, they are all role-playing. Something like a tomfoolery. They are mocking me as a citizen: a citizen of this country and a father of a dead soldier. Should I go to witness the judge saying the criminals are found guilty under this and this article and set free under other ones? The amnesty is granted especially to such criminals. Murderers, MargarOhanyans, and other criminals remain unpunished, while chicken and egg stealers continue serving their sentence. I’d rather spit on your justice…”, said M. Khachatryan.
