Court Passed Verdict of Guilty on Lia Misakyan’s Case
19:32, June 16, 2015 | News, Own newsOn June 15, 2015, the General Jurisdiction Court of Arabkir and Kanaker-Zeytun administrative districts of Yerevan, RA, presided by judge L. Avetisyan, announced the ruling on the criminal proceedings initiated against Lilit Vardanyan and Zarine Ayvazyan on the death of 2-year-and-3-month-old Lia Misakyan. Upon examining in a public court hearing the criminal case on charges against Lilit Vardanyan and Zarine Ayvazyan, physicians on duty at ‘Arabkir’ Medical Center, the Court found Lilit Vardanyan and Zarine Ayvazyan guilty under Article 130(2) of the RA Criminal Code by sentencing them to imprisonment for 2 years and 2 years and 6 months, respectively without additional sanctions.
At the same time, the Court applied Para 4(1) of the Amnesty Act passed to mark the 22nd anniversary of the RA independence and relieved the accused from the punishment. The preventive measure of a written undertaking not to leave applied to Lilit Vardanyan and Zarine Ayvazyan under the judgment remained unchanged until the judgment became legally effective.
Since the successor to the victim and his representative had not brought any civil action, the Court considered that issue resolved. The Court’s complete judgment will be published upon its receipt under the established procedure.
Note that 2-year-and-3-month-old Lia Misakyan had been admitted to ‘Arabkir’ Medical Center on December 31, 2012, at about 8:30 pm and died there on January 3, 2013, at about 12:20 am. Under the criminal proceedings initiated on this case, charges were brought against Lilit Vardanyan and Zarine Ayvazyan, physicians on duty at the ‘Arabkir’ Medical Center under Article 130(2) (Failure to implement or improper implementation of professional duties by medical and support personnel) of the RA Criminal Code, which prescribes a 2-6 years’ imprisonment, with deprivation of the right to hold certain posts and practice certain activities for the term of up to 3 years, or without that.
