J. B. Ozkirisyan’s Case in RA Administrative Court

Ozkirisyan (Shant Voskerchyan) was denied entry to the Republic of Armenia as his data were entered into the databank of undesirable aliens in the RA.
J. B. Ozkirisyan’s representatives, Chairman of HCA Vanadzor A. Sakunts and HCA Vanadzor lawyer A. Chatinyan, filed an administrative appeal to NSS on declaring the actions on entering his data in the databank of undesirable aliens illegal and removing them from the databank.
However, the NSS dismissed the appeal. The subsequent inquiries on the grounds and terms of the entry denial received no full answers as well; particularly, the response letter of the NSS stated that the entry denial against J. B. Ozkirisyan was imposed indefinitely and might be lifted if the evidence causing such denial no longer existed. Thus, the letter made no mention of the evidence for denying J. B. Ozkirisyan’s entry to the RA.
By their claim filed with the RA Administrative Court, J. B. Ozkirisyan’s representatives A. Sakunts and A. Chatinyan required that the Court declared unlawful the actions by the RA NSS on entering his data into the databank of undesirable aliens in the RA, as well as to annul the dismissal by the RA NSS of the administrative appeal and oblige the NSS to remove J. B. Ozkirisyan’s data from the database of undesirable aliens in the RA. By its ruling of November 13, 2015, the RA Administrative Court admitted the claim.
