Examination of Anush Poghosyan’s claim against Compulsory Enforcement Service to be resumed

Darbinyan, examined the administrative case under the claim filed by Anush Poghosyan against K. Paronyan, senior compulsory enforcement officer at Avan and Nor-Nork Division of the RA MoJ Compulsory Enforcement Service, on demanding to declare the lack of legal relations in resuming enforcement proceedings of January 22, 2016.
Note that at the previous pre-trial hearing, the plaintiff party motioned to allow making a substantive change in the claim and the court hearing on examining the motion was postponed.
The pre-trial court hearing was attended by plaintiff Anush Poghosyan and her representative, Tatevik Siradeghyan, Lawyer at Yerevan Office of HCA Vanadzor, and the Court had no information on proper notification of the RA MoJ Compulsory Enforcement Service.
To ensure the defendant’s right to express their position on change of the substance of the claim, the court hearing was postponed. Before the end of the court hearing, the plaintiff’s representative filed to the Court a motion on securing the claim and asked the Court to temporary grant plaintiff A. Poghosyan’s claim on declaring the lack of legal relations in resuming enforcement proceedings. The filing of the motion was conditioned by the fact that K. Paronyan, senior compulsory enforcement officer at Avan and Nor-Nork Division of the RA MoJ Compulsory Enforcement Service, applied to the general jurisdiction court to be granted permission to access A. Poghosyan’s apartment. The Court noted that the judicial act on the motion would be announced within the timeframe prescribed by law.
The court hearing was postponed till March 21, 2017, at 12 pm.
