The RA Prosecutor General’s Office “refers” the Organization to apply to court

Note that the agency responsible for the investigation committed a number of lawless acts under the criminal proceedings initiated on November 23, 2015 on the scuffle where R. G. was involved. According to R. G., the law enforcement agencies tried to conceal the crime in various ways, which was accompanied by threats towards R. G. and his family members; this is also proved by relevant records made by R. G.’s family members.
Based on the citizen’s application, HCA Vanadzor filed a crime report with the RA Prosecutor General’s Office and the RA SIS on ensuring the safety of R. G. and his family members, solving the crime and bringing to responsibility the perpetrators.
The RA Special Investigation Service did not decide on starting proceedings on the case; instead, it forwarded the crime report by a letter to the Internal Security Departments of the RA Investigative Committee and the RA Police to carry out a command investigation.
On April 12, 2016, HCA Vanadzor appealed the decision above of the RA Special Investigation Service to the RA Prosecutor General’s Office on the grounds that the RA Special Investigation Service was under obligation to make a decision under Article 181 of the RA Criminal Procedure Code on the report about the illegal persecutions by law-enforcement agencies against R. G. and his family members.
Moreover, the records on the threats by the law-enforcement agencies and their actions aimed at concealing the crime, submitted by the victims and attached to the crime report as evidence did not receive a proper assessment.
While under the RA Criminal Procedure Code, the powers of the prosecutor supervising the pre-trial proceedings also include initiating and conducting criminal prosecution, annulling the investigating agency’s and investigator’s decree on rejecting initiation of criminal proceedings, the RA Prosecutor General’s Office confined itself to stating by its letter of April 22, 2016 that a prosecutor had no right to examine such complaints and “referred” the Organization to apply to court.
HCA Vanadzor will take all the possible measures within its jurisdiction to stop the violations above.
