Appeal on the case of the person who died at the penitentiary facilities granted
16:20, January 11, 2017 | News, Own news | Right to Fair TrialToday, on January 10, 2016, the Court of Criminal Appeals, presided by Judge A. Azaryan, granted the appeal against the decree of the Armavir Marz (region) Investigative Department of the RA Investigative Committee of April 26, 2016 on discontinuing the criminal proceedings on the case and not prosecuting the other persons involved in the fight with Anzor Karapetyan on December 31, 2015.
The interests of Anzor Karapetyan’s successor are protected by Ani Chatinyan, lawyer at Helsinki Citizens’ Assembly-Vanadzor.
As a result of appealing the investigative body’s decree to higher agencies and subsequently before a court of law, on November 4, 2016, the General Jurisdiction Court of Armavir marz (region) rejected it stating that the affected party’s complaint was obviously ill-founded and should be rejected; such conclusion is not based on any reasons and grounds.
The aggrieved party appealed the first instance court’s ruling before the RA Court of Criminal Appeals.
In the appeal, A. Chatinyan stressed that the investigative body paid no due attention to the circumstances revealed in the testimonies of the persons questioned, which led to the violation of victim’s rights and freedoms.
Note that after the fight, A. Karapetyan presented himself to the police voluntarily and was then arrested and charged under Article 34-104 (attempted murder) of the RA Criminal Code.
On January 3, 2016, in the evening, A. Karapetyan was detained by a court ruling and transferred at night to Armavir Penitentiary, where some hours later he was found dead.
